These Terms of Use (“Terms”) govern your access to and use of parknationliving.com (the “Site”) and related services. By accessing or using the Site, you agree to these Terms.

1) Who We Are

This Site (https://parknationliving.com/) is managed by ParkNation Inc d/b/a ParkNation Living (“ParkNation,” “we,” “us,” “our”).

2) Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

 

    • violate any law or regulation,

 

    • interfere with Site security or functionality,

 

    • scrape, harvest, or collect information without permission,

 

    • submit false or misleading information,

 

    • attempt unauthorized access to systems or data.

 

3) No Guarantees; Informational Use

Information on the Site (including pricing, availability, photos, floorplans, amenities, and community details) may change and may not be current. The Site is provided for general informational purposes and does not create a binding offer.

4) Tour Requests and Communications

When you submit a contact form or tour request, you authorize us to contact you using the information you provide, including via email, phone, and text, consistent with our Privacy Policy and SMS Terms.

5) Intellectual Property

The Site and its content (text, images, graphics, logos, design, and software) are owned by or licensed to ParkNation and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works except as expressly permitted.

6) Third-Party Services and Links

The Site may contain links to third-party websites or services. ParkNation is not responsible for third-party content, policies, or practices.

7) Disclaimer of Warranties

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARKNATION WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE.

IF WE ARE FOUND LIABLE FOR ANY CLAIM, OUR TOTAL LIABILITY WILL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS FOR THE RELEVANT SERVICE (IF ANY), WHICHEVER IS GREATER, UNLESS A DIFFERENT LIMIT IS REQUIRED BY LAW.

9) Indemnification

You agree to indemnify and hold harmless ParkNation and its affiliates, officers, employees, and agents from claims arising out of your use of the Site, your violation of these Terms, or your violation of any rights of another.

10) Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except that if you are a consumer residing in California (or another state with non-waivable consumer protections), those protections still apply.

11) Disputes; Venue

Unless prohibited by applicable law, any dispute arising out of these Terms will be brought in state or federal courts located in Harris County, Texas, and you consent to personal jurisdiction there.

Optional: Arbitration / Class Action Waiver (only use if you implement proper clickwrap and want the fight)
If you want an arbitration clause, I can drop in a strong one — but don’t half-do it. Arbitration clauses get attacked when they’re hidden or your acceptance flow is sloppy.

12) Changes to These Terms

We may update these Terms at any time. Continued use of the Site after changes means you accept the revised Terms.
